TERMS AND CONDITIONS OF SALE

Our sales are subject to the present general terms and conditions of sale, which take precedence over any purchasing conditions. Placing an order implies the buyer’s full and unreserved acceptance of these terms and conditions of sale. Unless formally accepted in writing by the seller in advance, no special conditions may take precedence over these general conditions of sale.

1. ORDER

The seller is only bound by orders taken by its representatives and employees subject to written and signed confirmation from the seller to the person placing the order.

All orders placed by the customer with PGM PRECISION are processed by the prior dispatch of a price quotation accompanied by the present general terms and conditions of sale.

PGM PRECISION will only respond to special orders based on a quotation and for regulated use.

The customer’s order only becomes final after written confirmation from PGM PRECISION. Each line of the order confirmation constitutes a firm commitment on price and quantity, for both PGM and the customer

The buyer’s attention is drawn to the fact that products are manufactured and prepared specifically at the customer’s request.

Payment of a deposit by the customer constitutes unconditional acceptance of the sale.

The buyer is informed that the equipment sold by PGM PRECISION constitutes goods made to the customer’s specifications or clearly personalized, so that the right of withdrawal cannot be exercised in application of article L. 221-28 of the French Consumer Code.

However, for spare parts and accessories offered for sale in the website store, the right of withdrawal is exercised in accordance with the legal conditions.
Consumers have fourteen days to exercise their right of withdrawal.

This period runs from the day of receipt of the product by the buyer.

The buyer exercises his right of retraction by informing the seller of his decision to withdraw by sending, before the expiry of the aforementioned period, an unambiguous statement expressing his wish to retract.

Returns must be made in their original state and complete (packaging, accessories, instructions). In this case, the buyer is liable. Any damage suffered by the product on this occasion may be such as to defeat the right of retraction.

Return shipping costs are at the buyer’s expense.

All products sent for exchange or refund must be in their original packaging (packaging, accessories, instructions), unused and undamaged.

All returns must be approved by PGM by email contact@pgmprecision.com or by post.

In the event of exercising the right of retraction, PGM PRECISION will reimburse the sums paid within 14 days of notification by the buyer and via the same means of payment used at the time of the order.

2. PRICE

The prices invoiced to the customer are those in force on the day the order is registered, less any discounts, rebates or discounts applicable to the order. Prices may be changed at any time without notice and without liability to the customer.

Tariff prices apply only to weapons or parts of weapons and accessories, and exclude all charges such as postage, delivery charges, packaging, special inspections, certificates of conformity, specific insurance, taxes, etc.

Prices are quoted in euros, exclusive of VAT.

3. TRANSPORT – DELIVERY

PGM PRECISION delivers the equipment to the location indicated by the customer on the order form, under normal access conditions. Transport and customs clearance costs are not included in the sales price.

It is up to both parties, after consultation, to define in the contract, without ambiguity, the approximate or strict nature of a delivery time, which they finally agree upon. In the absence of such an express definition, the delivery time is deemed to be approximate.

Contractual deadlines will be extended for any reason that makes it impossible for PGM PRECISION or the customer to fulfill its obligations: bad weather, strikes, supply difficulties, accidental production stoppages, difficulties in obtaining export permits, etc.

PGM PRECISION is released from all liability in the event of incidents beyond its control, preventing the shipment, transport or delivery of the equipment sold. Unless otherwise expressly stipulated in the special conditions, delays in delivery, whatever the cause, shall not give rise to cancellation of the order and shall not give rise to penalties for delay or damages.

4. TRANSFER OF RISK AND RETENTION OF TITLE CLAUSE

Ownership of the goods delivered will only be definitively transferred to the customer once the latter has paid the price in full. Consequently, PGM PRECISION expressly reserves the right to assert its right of ownership over the equipment sold (law of May 12, 1980), and to repossess it at any time in the event of non-payment, even partial.

In all cases, products are transported at the risk and peril of the recipient customer, who is responsible for making any necessary observations in the event of damage or shortages upon receipt, and for confirming these reservations by registered mail with acknowledgement of receipt to the carrier, within eight days of receipt of the goods.

5. MERCHANDISE SPECIFICATIONS

PGM PRECISION’s only obligation is to deliver goods that comply with the technical description provided to the customer. However, PGM PRECISION may make any substitution or modification to the specifications of the goods, as long as the functioning of the whole is not substantially modified, but without being obliged to modify the hardware or software previously delivered.

Such modifications shall in no case justify cancellation of the order.

6. EXPORT AND IMPORT PROCEDURES

Precision rifles and accessories such as barrels, magazines and scopes are subject to export and import authorizations. These products cannot be exported or imported without prior authorization from the French government.

7. COMPLAINTS

Any complaint concerning apparent defects or lack of conformity of the product delivered with the product ordered must be made by registered mail within eight days of receipt of the product. After this period, the product is deemed to conform to the order in quality and quantity. In all cases, it is the customer’s responsibility to provide full proof of the existence of any defects or anomalies, and to allow the seller every opportunity to identify and remedy them.

A complaint does not authorize the customer to repair the disputed parts themselves or have them repaired by a third party, unless authorized in writing by PGM PRECISION.

8. WARRANTY

All our equipment is covered by the legal warranty under which the professional seller is obliged to repair all the consequences of hidden defects in the item sold. This warranty does not cover normal wear and tear of the equipment, nor the adaptation of this equipment to the customer’s needs, the latter being responsible for drawing up the specifications and choosing the equipment, nor damage of any kind that may result from use that does not comply with the recommendations and prescriptions formulated by PGM PRECISION, the inexperience of the user or a material accident, malice, carelessness or fraudulent intent on the part of the customer or his employees.

PGM PRECISION offers a contractual warranty against manufacturing or material defects on new equipment. The duration of this warranty is one year from the date of receipt of the goods and is exercised by return to the workshop. In the event of a workshop return, defective products must be returned by the customer in their original packaging. They must be accompanied by a return letter describing the nature of the defect, and a photocopy of the invoice. The return-to-shop warranty includes parts or sub-assemblies and labor. Shipment and reshipment costs and risks remain the responsibility of the customer. No returns will be accepted if these formalities are not respected. The warranty does not cover consumables and applies only to normal use of the equipment. This warranty does not apply to apparent defects.

9. REGULATIONS

In application of Law 92-14442 of December 31, 1992, any delay in payment in relation to the contractual dates will automatically give rise, from the day following the date of payment shown on the order form, to the application of late payment penalties equal to one and a half times the legal interest rate in force on the day of the due date, without this penalty affecting the payability of the debt. In the event of non-payment 48 hours after formal notice has been served, the sale will be cancelled ipso jure, and the seller may request the return of the products in summary proceedings, without prejudice to any other damages. Termination will apply not only to the order in question, but also to all previous unpaid orders, whether delivered or in the process of being delivered, and whether or not payment is due. In the case of payment by instalments, non-payment of a single instalment will result in immediate payment of the entire debt, without formal notice.

Our payment terms are those specified on the order acknowledgement.

10. ATTRIBUTION OF JURISDICTION

In the event of a dispute, the parties will seek conciliation, possibly through their respective professional organizations. Should this conciliation prove impossible, “the dispute will be submitted to the court in whose jurisdiction PGM PRECISION’s head office is located”, that is to Annecy.
